Refund Policy — 15-Day Money-Back Guarantee

1. Guarantee Period

Thmenu offers a full refund if you cancel your subscription within 15 days of your initial purchase. This guarantee applies to the first purchase only and does not extend to renewal periods.

2. Scope

All paid subscriptions are billed annually (no monthly plan is offered).

Paid plans (Lite, Pro, Platinum, Diamond) — annual subscription:
• Days 1–15: Full refund (money-back guarantee)
• Days 16–90: Pro-rated refund based on remaining months × monthly equivalent price
• Days 91–180: 25% of the amount paid
• Day 181 and beyond: No refund; full access continues until the end of the period

Starter (free) plan: No refund applicable since no payment is collected.

3. How to Request a Refund

No separate form is required:

1. Go to Settings → Subscription in your admin panel.
2. Click "Manage Subscription" (Stripe Customer Portal).
3. Cancel the subscription. If you are within the 15-day guarantee window, we process the refund on our side; absent failed-payment signals or abuse indicators, your refund is approved.
4. Once approved, refunds typically appear in your account within 5-10 business days, depending on your payment method and bank.

4. Renewal Periods

The 15-day guarantee applies only to your initial purchase. Renewal charges (day 365 of your annual subscription) are not refundable. You may, however, cancel before the next renewal to stop further charges; you keep full access until the end of the current period.

5. Your Statutory Rights (separate from this policy)

These rights exist by law and are not granted by us. If you are a consumer, you have an unconditional right to withdraw from a distance contract within 14 days — under the EU Consumer Rights Directive 2011/83/EU (and the equivalent UK provisions), and under Türkiye's Distance Contracts Regulation Art. 9. That right does not require a reason and is not subject to the exceptions in §6.

The 15-day money-back guarantee described in §1 and §2 is a commercial promise offered in addition to those statutory rights. It is longer than the statutory period and, from day 16, more generous than the law requires. Nothing in this policy replaces, shortens, or limits a right you have by law; where the two differ, whichever is better for you applies.

To exercise the statutory right of withdrawal, a message to contact@synaltix.io stating that you withdraw is sufficient — no form and no reason are required.

6. Exceptions (to the commercial guarantee only)

The following apply to the money-back guarantee in §1–§2. They do not apply to the statutory right of withdrawal in §5, which cannot be refused:

Abuse: If terms of service violations are detected, a guarantee refund may be declined.
Repeated refund requests: A pattern of subscribing and refunding repeatedly may be considered bad-faith use.
Third-party fees: Stripe processing fees (~2.9% + $0.30) are covered by us in both directions.

6.5 AI Usage Limit

AI features have a daily usage limit that varies by plan. When the limit is reached, the AI call temporarily stops responding and becomes available again after a cool-down.

You are not charged for exceeding the limit. AI usage is not metered or billed; it is included in your plan price. There is therefore no usage-based charge to refund under this heading.

6.6 Add-on Cancellation

The POS Adapter ($19/mo) and Language Pack add-ons can be cancelled at any time. Unused days are credited pro-rata toward your next invoice; languages from a cancelled pack revert to those included in your plan.

7. Affiliate Commissions on Refunds (affiliate users only)

Operational note — does not affect a restaurant's refund rights.

When a subscription is refunded, the corresponding affiliate commission is automatically reversed. The 90-day hold period (our chargeback buffer) makes this passive — unreleased commissions are deducted before they ever land in an affiliate's payable balance. For yearly plans, commission "drips" over 12 months — refunds cancel any remaining slices.

8. Chargeback Policy

Please contact us directly before initiating a chargeback through your bank. Most issues are resolved within hours by email. Direct chargebacks trigger our 90-day affiliate commission hold mechanism for review, and accounts that issue chargebacks without prior contact may be suspended for investigation.

9. Partial Refunds / Pro-rata

Partial refunds are available after the 15-day window, on the sliding scale set out in §2: pro-rated on days 16–90, 25% of the amount paid on days 91–180, and none from day 181 onward. §2 is the operative schedule — read it alongside this section.

From day 181, or where a request falls outside the scale, no money is returned; instead you keep full access until the end of the current billing period and are not charged again.

VAT and sales tax. A refund includes any VAT or sales tax charged on that payment; on a partial refund the tax is returned in the same proportion. Where the payment was invoiced at 0% under the reverse charge because you supplied a valid EU VAT number, there is no tax to return. Stripe calculates and returns the tax, and the whole amount goes back to the card you paid with.

Correction (2026-08-19): this section previously read "outside the 15-day guarantee window, partial refunds are not issued", which contradicted the schedule in §2. §2 was and remains the schedule we apply; the sentence here was wrong, and any request judged against it will be re-assessed on request.

10. Legal Entity & Jurisdiction

This policy is administered by Synaltix LLC (1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, USA). Thmenu is a trademark of Synaltix LLC.

Consumers resident in Türkiye: mandatory provisions of Law No. 6502 (Articles 1, 3, 6, 11 and 56-65) apply and cannot be limited by the Terms of Service §13 choice of law. Tüketici Hakem Heyeti and consumer court have jurisdiction (TKHK md. 73).

Consumers in the EU/EEA/UK: mandatory consumer protections of the country of habitual residence apply (Rome I Reg. 593/2008 Art. 6 + Brussels Ia Reg. 1215/2012 Art. 17-19). The EU Online Dispute Resolution platform ceased operation on 20 July 2025 (Regulation (EU) No 524/2013 was repealed by Regulation (EU) 2024/3228), so it is no longer a route to us or anyone else. EU/EEA consumers can find a competent alternative dispute resolution body through their national consumer authority or the European Consumer Centres Network (eccnet.eu). Consumers in Türkiye may apply to the Tüketici Hakem Heyeti or a consumer court.
